Orlando Misdemeanor
& Felony Criminal Defense Attorney
Florida law classifies criminal offenses as either misdemeanors or felonies. Misdemeanors are less severe crimes, punishable by up to one year in a county jail and a fine. Felonies are a more serious offense, including crimes such as robbery, kidnapping, burglary, and murder. A conviction is punishable by more than one year in a state prison and a substantial fine.
While the stakes are higher for a felony crime, both classifications have far-reaching impacts on your life, including suspending several civil rights. Even a misdemeanor can now serve as a basis for deportation, so non-US citizens should seek legal advice before entering any plea, including paying a criminal traffic citation.

Categories of Felonies and Misdemeanors
Depending on the severity of the crime, felony offenses are further delineated into three degrees: first, second, or third. The most egregious crimes are categorized as life or capital felonies. Capital felonies are punishable by death or life imprisonment.
Similarly, misdemeanor crimes are categorized as first degree or second-degree offenses. Some crimes can be charged as either a misdemeanor or felony depending on their severity and the defendant's criminal history. For instance, a first-offense petit theft (of less than $750) may be charged as a misdemeanor, but if a defendant has two prior convictions for theft, the offense may be elevated to a felony.
